TURNOUT Terms of Use
These Terms are between you and Turnout LLC ("we", "us"), a Florida limited liability company. By using TURNOUT you agree to them. If you don't agree, don't use the app.
1. Health and safety: please read
TURNOUT is not medical advice and not a fitness-for-duty tool.
TURNOUT helps you track fuel, sleep and recovery across your tour. Its scores and targets are general estimates built from what you log; they are not a diagnosis, treatment, or professional recommendation. TURNOUT can't tell you or your department whether you're fit to work a shift, and it must not be used by you, an employer, a department, or anyone else to make fitness-for-duty, staffing, disciplinary, insurance, or medical decisions.
If you feel unwell, have chest pain, or something seems off, stop and talk to a doctor or your department's medical officer. In an emergency, call 911. Talk to a qualified professional before changing your diet, sleep, or training, especially if you have a medical condition.
2. Your license
We give you a personal, non-exclusive, non-transferable, revocable license to use TURNOUT on Apple devices you own or control, as permitted by the App Store Terms of Service and Apple's Standard Licensed Application End User License Agreement (apple.com/legal/internet-services/itunes/dev/stdeula), which is part of these Terms.
3. Your data
TURNOUT has no account and stores your information on your device. Our Privacy Policy explains what the app reads (including read-only Apple Health access), the food lookups it sends to Open Food Facts, and how to delete everything with More › Delete all my data. You're responsible for your device's security and backups. Because we don't hold your data, we can't restore it if it's deleted or your device is lost.
4. Food information
Nutrition information may come from Open Food Facts, a public, community-edited database, or from what you enter. It may be incomplete or wrong. Check labels, especially for allergies.
5. Acceptable use
Don't reverse engineer, resell, or misuse the app, use it to break the law, or present its scores as medical or fitness-for-duty determinations about anyone.
6. Changes and availability
We may update, change, or stop offering features. We may update these Terms; if the change is significant we'll tell you in the app. Continuing to use TURNOUT after that means you accept the updated Terms.
7. Disclaimers
TURNOUT IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DON'T WARRANT THAT SCORES, TARGETS, OR NUTRITION DATA ARE ACCURATE OR SUITABLE FOR YOU.
8. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, WE WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY INJURY, ILLNESS, OR LOSS ARISING FROM RELIANCE ON THE APP. OUR TOTAL LIABILITY IS LIMITED TO THE GREATER OF WHAT YOU PAID US IN THE PAST 12 MONTHS OR US$50. Some places don't allow these limits, so they may not apply to you.
9. Apple
These Terms are between you and us, not Apple. Apple isn't responsible for TURNOUT or its content, has no obligation to provide maintenance or support, and, to the extent allowed by law, has no warranty obligation beyond refunding the purchase price (if any). We, not Apple, are responsible for handling any claims about the app (including product liability, legal compliance, consumer protection, and intellectual property claims). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. You confirm you're not in a US-embargoed country or on a US restricted-party list.
10. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules.
